It is absolutely illegal to use or reproduce a photographers photos in any form unless you have permission from the photographer. Dealing with the photographer directly is always the better choice unless you deal with a model who can provide you with a release form from their photographer that they use. Your rights when you get photos done are limited to having the prints that you order, unless otherwise stated by the photographer. You can't post them online without permission, you can't duplicate them without permission, normally you have to order prints directly from the photographer, etc... If they give out cds, its possible that they allow photos to be posted online or prints made personally but its always best to check with the photographer first. There are heavy fines for illegally using a pro's photos without the proper permissions.

In all honesty, you won't find many people who are going to follow up on alot of their work to make sure its not being used without their permission, but its always better to be safe than sorry.

What I meant was that you have verbal permission from the photographer to use the images in exchange for photo props, but hadn't realised that everyone gets written consent as well. Of course it's illegal to use images without permission, I'm well aware of that.. the reason I watermark every single one of my images.

If you are dealing with the photographer directly, verbal permission is ok as long as you aren't dealing with someone who's out to cause trouble... I would suggest written permission if you use a model who's photographer is not direct relation such as the mother / father of the child...
