EUGENE, Ore.--Local resale shops and thrift store patrons are breathing sighs of relief, after federal regulators reversed course Thursday, saying thrift stores and second hand shops do not have to test used products for lead.
Earlier this week, some resale shop owners stopped taking clothing trades, worried they might have to close their stores.
Pam Simons, who owns the Eugene resale shop Kidstuff, was one of them.
"t caused a lot of tension for a lot of people," said Simons. "Not just business owners, but customers were really upset by it. So we're relieved."
The Consumer Product Safety Improvement Act requires clothes, toys and products for children under age 12 be tested for lead and pthalates. Earlier this week, the Consumer Product Safety Commission said that included used products.
Now, the CPSC says resale stores are not responsible for testing items.
However, the stores can not sell items that do not meet the new lead standards. If they do, they could face civil or criminal penalties.
Terry McDonald, executive director of St. Vincent de Paul, said he's asked the federal government for more clarification.
McDonald says St. Vincent's could be found liable for unknowingly selling an item with lead or pthalates in it, so he would like the government to tell resale shops what dangerous items to look out for.
"Obviously, what we want to do is make sure the products we've been putting out to the public are indeed safe, they've identified if they are not and tell us what they're look for," said McDonald. "We can't be the stewards of this product without knowing what's going on."
St. Vincent's already does not sell children's furniture and products like car seats because they could be held liable if the product turns out to be defective, said McDonald.
Without further clarification from the government, McDonald says St. Vincent's might consider removing children's products from the stores.
On Wednesday, the CPSC tentatively approved some exemptions to the new lead testing law. Among them, children's products made from natural products like wood would not required testing.

The good news is there are changes occuring now. However, I don't think our bows are covered in any of them.

What i don't get is that we all buy our bow makeing products (Ribbon, Clips Etc) from a store (Wal-mart, Hobby Lobby or wherever) Arent the products tested before they go on the market? So whats the big deal if we add a couple or loops to some ribbon and call it a bow! It should not be our job to test products we did not make! ( We only enhanced an already existing product!) The manufacturers of the ribbon and clips should test for that stuff not us! That's is just so beyond stupid in my opinion . It is like blaming a mom who made her kid a pb&j sandwich and the kid got sick because of salmonella . The mom didn't make the peanut butter a company did. We don't make the ribbon a company does so they should be responsible for there products not us. I mean come on its not like we are sitting around growing cotton and spinning it in to ribbon ourselves. If the manufacturers don't test the products its there fault not ours . So if the products are unsafe they should get in trouble not us. GRRR this is making me sooo frustrated !!!!

Excellent point. I'm so frustrated because I finally just started selling my bows, and having some good success with it...and now this happens. I have a friend of mine who is forced to close down her online shop because of these new regulations. So sad.

THe above was take from here

So if I make a hat or bow, put it on my daughters head, it is now USED since she has worn it...Can I sell that without testing?

I suppose BUT in the fourth paragraph of the same link above it says this "However, resellers cannot sell children’s products that exceed the lead limit and therefore should avoid products that are likely to have lead content, unless they have testing or other information to indicate the products being sold have less than the new limit. Those resellers that do sell products in violation of the new limits could face civil and/or criminal penalties"


Yes, resellers aren't required to test but cannot sell items that exceed the lead limit of the new law or they face the same penalties. How are you supposed to know unless you test??

So how can consignment stores & resellers be exempt from this if they dont test either?
