I came across this listing on etsy and I think it sounds so rude. If I was 'just a customer' I would totally be turned off by this listing. Being a bow maker, I do understand why she's saying that but I don't think it's appropriate to write it in the top of the description!!

OH PUH-LEASE!!! I have to say that she is full of it!! I highly doubt hse has a patent on a ring, covered in ribbon with a piece of ribbon hanging from it!! Personally, I think she's just BSing. I agree it is a little rude to make the comment like that!

WOW thats crazy!!! I don't understand why she feels the need to put that in her listing I can see if she wanted to put something about it at the bottom but thats the first thing you see she has got issues or something

i get soooo sick of people claiming trademarks, copyright, and patent on ideas that may be original to them. Here is the law on patent, which cost hunderds of dollars in application fees and attorney fees. To me this is not a item worth patenting, it isn't that original. It is cute but headband/bowholders have been around. It like trademarking "that's hot" (should we open THAT can of worms )and it also cost over 350 for trademark.

PATENT MARKING AND "PATENT PENDING"
(Excerpted from General Information Concerning Patents print brochure)
A patentee who makes or sells patented articles, or a person who does so for or under the patentee is required to mark the articles with the word "Patent" and the number of the patent. The penalty for failure to mark is that the patentee may not recover damages from an infringer unless the infringer was duly notified of the infringement and continued to infringe after the notice.

The marking of an article as patented when it is not in fact patented is against the law and subjects the offender to a penalty. Some persons mark articles sold with the terms "Patent Applied For" or "Patent Pending." These phrases have no legal effect, but only give information that an application for patent has been filed in the Patent and Trademark Office. The protection afforded by a patent does not start until the actual grant of the patent. False use of these phrases or their equivalent is prohibited.


I have seen these before. So if she truly has a patent pending, she needs to list the number provided via her application w/ her listing or she could face legal charges pressed against her from the government. Also, you can change the attachment from velcro or snap closure, whatever, tada, you have your "own" original product. Why do you think there are 20 different crib, playpen, swing companies out there. You can change any design slightly and you aren't infrining on patents or copyrights or trademarks. I'm sorry about the run-on. I am all for someone coming up with a great, unmarketed idea and running with it. For example: The GatorBite, a truly patentable item. It is worth the inventor to do this because she saw a need came up with something, trialed it, improved it, trialed it again. It is a unique item, not a common hand-made item. If this lady really feels as though her idea, is unique only to her, not-out-there already then great do it, but do it correctly. Hire her a attorney, find out if she can even do it, file an application and list her patent pd. # and trademark her name for the item, though headband holder isn't able to be trademarked due to common word usage. Anyone feel smarter yet?

You have got to be kidding!! How desperate does she sound to sell something!! SELFISH if you ask me. That is sooooo why I love this forum. People are not just thinking about themselves, we all want to share and help each other. Life is so much better when we serve and give to others! That bow holder is nothing special and frankly it is not even the least bit cute. It is quite ugly to me. So I really don't think that she should worry too much of people stealing her idea. WOW

Good morning Judy, darn, i am caught by my husband sneaking in the forum. I am suppose to be making hairbows. Anyway, If you read the long posting I put up this morning I addressed the legal asspect in it. I guess I better get off.
