As far as getting a "patent", I know that it is an extremely expensive process. I wouldn't think it would be worth it because there would be no guarantee that it would be granted a patent.
I think paid instructions are a great idea. It would be pretty easy to copyright them.
You may be correct about the cost of going all the way through the patent process but the initial application may not be that expensive and you might be able to label the product "patent pending".
I'd be interested in knowing what the OP decided to do.
