First thing I would suggest is to go into the menu and set your auto focus (AF) area to 'single' instead of 'dynamic' or 'closest subject'. I find that the Nikon tends to pick whatever you DON'T want to focus on by default

However, in the D40, there's a bug in the software -- if you change to another setting (ie from Auto to Portrait etc) it will lose that setting and you have to change it again.

Perhaps that's what's causing some of the bad pics, just bad focus?
